The Equal Employment Opportunity Commission has seen a spike in complaints from workers who say they were fired for refusing a flu vaccine, and it has filed a number of suits this year on their behalf, contributing to a growing body of litigation in the battle over religious rights that is just beginning to take shape.

“What you see is a tension between the health care employers’ desire to maintain the highest level of patient safety and an individual health care worker’s right to religious expression,” Epstein Becker Green employment attorney Nathaniel Glasser said. “Despite these handful of cases that have considered the religious exemption in this context, very few of them have really gone to the heart of that tension.”
