The ABM case is important because a decision affirming the lower appellate court could put an end to scores of pending class actions posing similar arguments, or, if reversed, could open the floodgates to more such suits, according to Michael S. Kun, the Los Angeles-based head of Epstein Becker Green PC’s wage-and-hour practice group.
“It definitely could be a game changer and have a significant impact on a great many employers in California,” Kun said.
