Claims under the American With Disabilities Act (ADA) have increased dramatically since Congress amended the law and the EEOC issued its final regulations. Many of the new claims concern mental disabilities, which are now called intellectual disabilities. As a result of the changes in the law and the increased number of claims, employers must deal carefully with employees who claim to have disabilities relating to:
- the ability to think, concentrate, communicate, or interact with others, or
- disorders such as anxiety, depression, post-traumatic stress, obsessive compulsion, bipolar, or schizophrenia.
