Massachusetts federal prosecutors are pursuing novel and complex white collar criminal cases against individuals ranging from pharmaceutical executives and pharmacists to a former State Street vice president and even Boston city officials, which experts say are worth watching for practitioners in the commonwealth and beyond. …

Former Insys Therapeutics Executives

On the health care front, the case against six former executives at Insys Therapeutics Inc. is one to keep an eye on as Attorney General Jeff Sessions’ U.S. Department of Justice cracks down on the black market for opioids.

The former executives are accused of bribing doctors in multiple states to prescribe the powerful opioid fentanyl by having Insys sales representatives reward top prescribers with paid “speaking” opportunities. One former manager has pled guilty.

Melissa Jampol, a former federal health care prosecutor who practices at Epstein Becker & Green PC, said the case is “without a doubt one of the most important and high-profile white collar or health care fraud cases in the country right now.”

Jampol said the case is part of a trend of “cutting-edge, innovative and complex” health care indictments from Massachusetts federal prosecutors, which also include the murder and racketeering trial of a pharmacist at New England Compounding Center and the trial of former Warner Chilcott President Carl Reichel. Reichel was acquitted last year on kickback charges that somewhat resemble those in the Insys case.
