The ADA is an especially poignant example of the power of court decisions to have an impact on a law. It was two major U.S. Supreme Court decisions and several lower court decisions that created the catalyst for the ADA Amendments Act of 2008, which gave the law a significant facelift that expanded the definition of a disability and forced disputes to focus more on employers’ accommodations of disabled workers.
“When the ADAAA was ultimately agreed upon and passed, it not only eradicated those Supreme Court decisions, but it shifted the focus [of the law],” Josh Stein of Epstein Becker & Green PC said.
