“The manner in which the court issued the decision was very forceful,” Epstein Becker & Green PC’s Jeffrey Ruzal said. “It clearly stated that the DOL had exceeded its rulemaking authority.”
The DOL appealed the ruling to the Fifth Circuit in early December and was granted expedited review, but with the Trump administration looming, Ruzal said he isn’t sure how far the appeal will go. Still, with the injunction coming so soon before the deadline, many employers aren’t coming out of the case with their checkbooks intact.
“Certain employers who wanted to get ahead on payroll decided to implement, and now they’re coming to think, ‘Can I scale this back? I’m leaving money on the table,’” Ruzal said. ‘The significant problem there, while not necessarily legal, is employee relations. An issue of morale.”
