Gregory Keating, Member of the Firm, will co-present “It’s a Mess Out There: An Update on Whistleblower Retaliation Law,” a virtual CLE webinar hosted by the Boston Bar Association.
This CLE program will review the dizzying array of statutory and common-law protections afforded to employees who blow the whistle at work—a list that continues to expand with recent federal statutes. The program will discuss major laws of which employees, management, and practitioners should be aware, and the often unique procedural schemes governing their enforcement.
- The major federal antiretaliation laws administered by OSHA, including the Sarbanes-Oxley Act (SOX), OSHA Section 11(c), and new statutes protecting tax, antitrust, and money-laundering whistleblowers.
- The administrative procedures and prerequisites that whistleblowers in OSHA must follow.
- The False Claims Act and other major federal antiretaliation statutes outside the OSHA framework.
- State-law protections such as the Massachusetts False Claims Act, Health Care Worker Whistleblower Act, and Public Employee Whistleblower Act, and the doctrine of wrongful termination against public policy.
