Wage and hour lawsuits and enforcement efforts have skyrocketed over the past few years, and health care companies are one of the primary targets. This alarming trend has been continuing in 2012. In recent weeks, the U.S. Department of Labor has initiated a number of surprise on-site audits. Likewise, class action lawsuits have increased exponentially, often resulting in settlements or judgments of millions of dollars. The issues generating the most litigation involve calculation of overtime, misclassification of employees as exempt or as independent contractors, automatic deductions for meal breaks, and working off the clock. In this presentation, we will cover best practices on the following topics:
