The report highlighted a huge jump in DOJ-initiated FCA actions involving health-care fraud from 26 last year to 69 for FY 2016, the highest of any year since reporting began in 1987, and more than double the number filed in any year since 2011. The increase is “a result of increased resources given to the DOJ,” George Breen, a healthcare attorney at Epstein Becker Green in Washington, said.
Breen told Bloomberg BNA Dec. 15 the shift in resources is allowing the DOJ to pursue more of its own independent investigations, and “reflects a focus of the current administration on both corporate entities and individuals.” With more DOJ resources devoted to health-care fraud, “the natural result is more [nonwhistle-blower] filings,” Breen said.
