Paul DeCamp, Member of the Firm, co-presents "Challenges to the Administrative State / Impact on Wage & Hour Regulations" as part of Wage & Hour Litigation and Compliance 2026, a full-day program hosted by PLI.
Following the Supreme Court’s 2024 Loper Bright Enterprises v. Raimondo decision that limited deference given by courts to agency regulations, U.S. Department of Labor wage and hour regulations have been under increased scrutiny. This panel will review how changes in the amount of judicial deference given to the regulations is impacting litigation and compliance. From this panel, participants will:
- Analyze the impact of judicial challenges to new and revised U.S. DOL policies and regulations
- Learn the latest judicial developments in this rapidly changing legal environment and what deference, if any, that courts are giving to wage and hour regulations under Skidmore and Auer
- Gain practical tips for complying with new policies and regulations that are expected under the Trump Administration, such as the overtime exemption salary thresholds for executive, administrative and professional workers, tipped worker rules, prevailing wage rules, and home healthcare worker rules
