Christopher Farella, Member of the Firm, presents "Hot Topics in Legal Ethics in Commercial Real Estate" as part of the Practising Law Institute (PLI) 26th Annual Commercial Real Estate Institute, which runs from November 4 to 5.

This session discusses the Rules of Professional Conduct with instruction on how they apply in the practice of commercial real estate. Upon completion, participants will be able to:

  • Understand their obligations to be competent in the use of technology, including the use of AI tools
  • Prepare engagement letters that clearly define the scope of the attorney-client relationship in transactions and affirmatively bring representations to an end
  • Identify and address potential conflicts of interest, knowing when waivers are needed or when not allowed, and the use of advanced waivers
  • Be current on what qualifies as “practice of law” to avoid unauthorized out-of-state practice, particularly during current hybrid work arrangements; and
  • Use of (and dangers of) transactional common interest agreements
