The HITECH Act (Health Information Technology for Economic and Clinical Health Act) offers a carrot (incentive payments for "meaningful use" of EHRs (Electronic Health Records)) but introduced a huge new stick (federal data breach reporting requirements with material new penalties and enforcement ability by state attorney generals).
