Health Care Provider Affirmative Action and OFCCP Audit Basics - Who? What? When? Where? Why? How?

The Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) has positioned itself to audit health care providers that previously had remained beyond its jurisdiction.
The OFCCP's issuance of Directive 293 and recent litigation has evinced the Agency's intent to audit health care providers' affirmative action plans (AAP) where insurance provider agreements with insurance plans provide health care services to federal employees under Medicare Advantage and Prescription Drug (Parts C and D) and, where TRICARE and FEHBP services are rendered (military and federal employees).
The OFCCP's aggressive posture may catch providers that historically have not been subject to audit unprepared. This briefing is for hospitals, outpatient facilities, insurers, pharmacies, claims processing services and, practice groups interested in gaining a general understanding of regulatory and record keeping requirements tied to AAPs; liability concerns to consider in the event of an OFCCP audit; and, best practices for preparing for and successfully maneuvering an OFCCP audit.
