Sponsored by Epstein Becker Green
After years of little or no enforcement, the Health Insurance Portability Accountability Act of 1995 ("HIPAA") has been supercharged by the Health Information Technology for Economic and Clinical Health ("HITECH") Act. Since the HITECH Act was enacted, the Department of Health and Human Services Office of Civil Rights ("OCR") has assessed fines totaling $9.5 million. Over $6 million of those fines have been levied in 2011 alone. Moreover, the number of OCR investigations has increased as well. In 2010, OCR reviewed a total of 9158 complaints; 4229 moved to a full investigation and 2703 resulted in a corrective action.
In this 90-minute webinar, attorneys from Epstein Becker Green's Healthcare and Life Sciences Litigation and Government Investigations Practice will examine the recent surge in healthcare privacy and security enforcement. These EBG attorneys have significant experience in privacy and security issues, with specific proficiency in preventing and responding to data breaches, in addition to extensive experience in defending health care entities in government investigations and litigation.
Key points to be addressed include:
- HIPAA/HITECH overview, with emphasis on enforcement provisions.
- Recent cases and settlements — it's not just about data breaches anymore!
- Reducing reportable incidents.
- Responding to the OCR effectively, both legally and technologically.
- Managing a government investigation as well as risk assessment and litigation defense strategies.
- Forecast for the future.
Speakers: George Breen, Robert Hudock, Carrie Valiant, and Patricia Wagner
