After years of little or no enforcement, the Health Insurance Portability Accountability Act of 1995 ("HIPAA") has been supercharged by the Health Information Technology for Economic and Clinical Health ("HITECH") Act. Since the HITECH Act was enacted, the Department of Health and Human Services Office of Civil Rights ("OCR") has assessed fines totaling $9.5 million. Over $6 million of those fines have been levied in 2011 alone. Moreover, the number of OCR investigations has increased as well. In 2010, OCR reviewed a total of 9158 complaints; 4229 moved to a full investigation and 2703 resulted in a corrective action.
