In 2010, all of the federal agencies responsible for enforcing federal employment laws will step up enforcement audits and investigations. The Department of Homeland Security will conduct more I-9 audits, the Equal Employment Opportunity Commission (EEOC) will aggressively investigate charges of discrimination, the Internal Revenue Service (IRS) will conduct more audits regarding misclassification of Independent Contractors, and the Department of Labor's agenda includes increased audit and enforcement proceedings related to the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), the Employee Retirement Income Security Act (ERISA), and the National Labor Relations Act (NLRA).
Likewise,the California Employment Development Department (EDD), the Department of Fair Employment & Housing (DFEH), and the Division of Labor Standards Enforcement (DLSE) will actively audit and investigate employers for violations of state laws.
