The post-employment non-compete landscape continues to change all over the country. At the federal level, the Federal Trade Commission (FTC) has proposed a rule that would ban non-competes nationwide, spurring multiple legal challenges. A Texas federal judge will decide a challenge to the FTC non-compete ban. On the state level, several state legislatures passed bans that were vetoed; California expanded the reach of its non-compete ban; and, over recent years, numerous states (including Illinois) have placed limitations on the use and enforcement of non-competes.
Panelists discuss how employers can navigate uncertainty in the current landscape of non-compete laws in the United States, with an emphasis on addressing the intricacies and pitfalls of the FTC’s proposed non-compete ban, practical tips to deal with the possible future outcomes of the litigation challenging the ban, and other ways to protect employers’ legitimate business interests and guard against unfair competition.
