This presentation explores the latest trends and upcoming changes in labor law, focusing on how they may impact employers whose employees are not represented by a labor union. Speakers cover key legal decisions, and emerging regulations, to provide attendees with insights into compliance strategies and proactive steps to help minimize the risk of a union organizing campaign. Also discussed are likely changes to labor law, depending on which party wins in the November 2024 presidential election.

Greg Keating and Lydia Pincsak present "High Stakes Workplace Investigations." This panel provides an update on whistleblower laws and enforcement activity, while also walking through case studies of recent high-profile investigations involving civil and criminal components. The panel will assist attendees with identifying the attorney-client privilege issues and public relations/crisis management concerns during a workplace investigation.

Jimmy Oh, Kathleen Barrett, and Corben Green present "The New Playbook: What the Supreme Court’s Rulings on Agency Power Mean for Government Action Challenges." The Supreme Court wrapped up a blockbuster term, which dramatically transformed the dynamic between federal agencies, such as the Department of Labor, and the entities they regulate. From overturning the 40-year-old Chevron doctrine to expanding the right to challenge decades old federal regulations, to stripping a federal agency of their power to seek civil monetary penalties through an administrative proceeding, the Supreme Court has opened doors to legal challenges against agency actions past, present, and future. The panel explores how these recent Supreme Court landmark decisions will alter agency actions and uncovers a new playbook of enhanced opportunities for businesses to challenge agency statutory interpretations.
