The federal administrative state is attempting to ban non-competes and target employers that use and enforce them while states try to limit their application. Employers also face heightened whistleblower protections and a greater need for sensitive, high-level internal investigations. Additionally, there has been an increase in requests for remote work and mental health-related accommodations post-COVID-19. As expectations for in-office work are growing, employers are being inundated. And, with a national election in a couple of months, even more changes could be on the horizon. Uncertainty is the “new normal” for employers in New England and beyond.
