Nathaniel M. Glasser, Member of the Firm, will participate in the panel discussion "Big Data and People Analytics - The Impact of Predictive Analytics on Traditional Employment Decisions," at the American Bar Association (ABA) National Symposium on Technology in Labor and Employment Law.
Predictive analytics have revolutionized marketing practices in corporate America, and Human Resources departments increasingly are looking to apply similar analytical processes to functions under their control. These “people analytics” techniques take many forms – from text mining and machine learning to robotic process automation – with the goal of streamlining and improving current, sourcing, recruiting, hiring, and even promotional practices. While people analytics promise efficiencies and cost savings, these techniques also risk perpetuating stereotypes or disparate impact. This panel will discuss the advantages and disadvantages of incorporating people analytics into employment decisions, identify the associated legal and practical implications, and address the potential for regulatory review.
