Richard W. Westling, Member of the Firm, will participate in the panel discussion, "Litigation in Civil vs. Criminal Healthcare Fraud Cases: Is there a Double Standard?" at the American Bar Association (ABA) 19th Annual Emerging Issues in Healthcare Law Conference.
Healthcare fraud can be prosecuted criminally or civilly. While higher burdens of proof are an obvious challenge for the government in criminal cases, criminal prosecution can also avoid civil evidentiary burdens, such as statistical evidence, materiality and reciprocal discovery obligations, that often burden the government as a civil litigant. This panel will explore how the differences between civil and criminal healthcare fraud cases can make criminal prosecution an attractive alternative to FCA litigation.
