Daniel Levy, an Associate in the Health Care and Life Sciences and Labor and Employment practices, in the Newark office, was quoted in an article titled “Lawsuit Alleges Lax Security Led to Shooting Death of Lawyer at Mall.”
Following is an excerpt:
A lawsuit over the carjacking that took the life of a young lawyer at a posh New Jersey mall accuses the owners of skimping on security even though the upscale customers who shop there tend to drive the kinds of luxury vehicles that attract such crimes. ?…
The suit also names Universal Protection Service of Santa Ana, Calif., a security company that allegedly failed to provide adequate protection, and the Millburn-Short Hills Volunteer First Aid Squad, which responded to the 9-1-1 call. ?…
Volunteer first aid squads are generally immune from liability under New Jersey law, but courts have applied that immunity on a case-by-case basis and it can be overcome by a showing of intentional wrong, gross negligence or that the squad wasn’t supplying services in good faith, says Daniel Levy, who represents hospitals, health-care companies and emergency services providers.
