George B. Breen, a Member of the Firm in the Health Care and Life Sciences and Litigation Practices, was interviewed for the American Medical News program on the ReachMD radio network about health care fraud remaining a key target of the federal False Claims Act.
Breen pointed out that the civil fraud recoveries recently reported by the Department of Justice tell only part of the story. When considered in connection with the current economic and enforcement climates, the recoveries suggest that False Claims Act cases against health care providers will continue to grow in the coming years.
Breen noted the enactment of the Fraud Enforcement and Recovery Act of 2009 ("FERA") and pending legislation, such as the Health Care Fraud Enforcement Act and the Fighting Medicare Payment Fraud Act, as additional tools designed to assist the Government in its pursuit of health care providers.
