Epstein Becker Green (EBG) hosts “Applying Fraud and Abuse Laws and the No Surprises Act in Day-to-Day Practice: Advanced Discussion and Practical Advice for Florida Health Care Attorneys.”
Led by EBG attorneys Elizabeth Kastner, Shannon DeBra, Robert Hearn, and Elizabeth Scarola, this advanced course will be broken into three sessions.
In the first session, speakers will provide an advanced review of the federal and Florida restrictions on physician referrals, kickbacks, and patient inducements, including the federal Stark Law, the federal Anti-Kickback Statute (AKS), the beneficiary inducements provisions of the Civil Monetary Penalties (CMP) Law, the Florida Patient Self-Referral Act, the Florida Anti-Kickback Statute, and the Florida Patient Brokering Act. The discussion will include a review of commonly used exceptions and safe harbors, with examples from recent enforcement actions.
In the second session, attendees will be able to apply the laws reviewed beforehand to hypothetical cases like those likely to appear in a Florida health care attorney’s day-to-day practice. Each case study will require issue spotting and analysis of at least two of the laws previously discussed. The session will conclude with practical advice to attendees on how to communicate fraud and abuse analyses to business teams in order to further strategic initiatives compliantly.
Finally, in the third session, speakers will provide an overview of the federal No Surprises Act (NSA) and the current status of important elements of the NSA, including the various enforcement moratoriums in place relative to specific portions of the NSA, the development and amendment of state balance billing laws and their interactions with the NSA, and more.
The program will conclude with a question-and-answer session for program attendees.
