The debate over who owns, controls, and benefits from the use of patient health data, and how those data are protected, has only intensified as the value of these data in the marketplace grows. This webinar starts with a discussion of the main legal issues implicated by the use of protected health information and other patient health data (whether de-identified or not), for secondary uses. Kate and others discuss some of the legal parameters surrounding how patient data is used in clinical research, as well as secondary research uses of both research and clinical data, and some of the specific challenges raised in negotiating partnerships between academic and industry related to the use of patient data. The webinar also addresses ethical considerations intertwined in the use of de-identified data. With this background, Kate and others walk through case studies to provide real-world context to the issues that need to be considered surrounding the secondary use of de-identified data.
