Epstein Becker Green represented a coalition of organizations in their filing of an amicus brief before the U.S. Court of Appeals for the Fifth Circuit in Braidwood Management v. Becerra.
The brief argued that the Affordable Care Act’s requirement to cover pre-exposure prophylaxis (PrEP) for HIV does not substantially burden religious exercise in violation of the Religious Freedom Restoration Act. The brief further argued that a wholesale invalidation of the coverage requirement for the U.S. Preventive Services Task Force’s recommendations would strike a critical, unnecessary, and costly blow to the battle to end HIV, hepatitis, and other infectious diseases.
