Epstein Becker Green litigators prevailed in the New York State Supreme Court, Appellate Division, First Department, which unanimously affirmed the trial court’s granting of summary judgment in an age discrimination case brought against an international financial services provider under the New York City Human Rights Law.
Despite the extremely liberal standard applied under New York City’s anti-discrimination law, the First Department rejected the plaintiff’s contention that age was “a” motivating factor in the decision made by our client to eliminate a specialized compliance position held by the plaintiff for two years. The First Department also noted that our client’s evidence of its legitimate business reasons was undisputed and the “[p]laintiff’s efforts to manufacture a genuine issue as to [the] defendant’s reasons by misrepresenting record testimony and documentary evidence are unavailing.”
