When in-house counsel begins an internal investigation, that attorney is immediately thrust into a variety of roles, including investigator, advisor, confidante, defender, prosecutor, and beyond. Each role, and the contrast of roles, raises a host of ethical issues: Who is, and is not, the client? How, when, and to whom do you explain that? When can employees be interviewed without their attorneys present? Are there limits on how and where evidence can be gathered? This workshop will focus on how the Rules of Professional Conduct can apply to such investigations by examining a fact pattern that will likely sound familiar.
