Frank C. Morris, Jr., Member of the Firm, will copresent a telephone seminar, "Americans with Disabilities Act and Amendments: Recent Developments," hosted by ALI-CLE.

The ADA Amendments Act (ADAAA) shifted the focus of litigation and compliance from whether an individual has a disability to whether an individual is qualified, whether there is discrimination, and whether there is a "reasonable accommodation" available that would permit a person with a disability to perform the essential functions of the job.

How have employers' and employees' rights and responsibilities changed since the enactment of the ADAAA's final regulations on March 25, 2011? Find out from a key EEOC official and leading employment law attorney in this informative, accredited CLE program on the ADA Amendments Act.

Speakers will analyze the current status of legal opinions since the implementation of the Americans with Disabilities Act Amendments Act regulations in 2011 and identify trends to watch as this fast-paced area of law continues to develop.

Topics for discussion include:

  • judicial interpretations of the EEOC's ADAAA regulations
  • how courts are handling pregnancy-related conditions, psychiatric impairments, and other diagnoses under the ADAAA
  • litigation tips -- new decisions on ADAAA pleading and evidentiary pitfalls
  • rulings on the new "regarded as" coverage, and its implications for employers
  • update on "qualified" and "undue hardship
  • allergies-- key issues and evolving developments
  • medical inquiries--what is and is not a medical inquiry including mandatory counseling and "fitness for duty" exams

Questions submitted during the program will be answered live by the faculty. In addition, all registrants will receive a set of downloadable course materials and free access to the archived online program.
