Enforcement of the Foreign Corrupt Practices Act ("FCPA") is at an all-time high and it appears this trend will continue as the  Department of Justice ("DOJ"), the Federal Bureau of Investigation ("FBI") and the Securities and Exchange Commission aggressively target individual executives and board members using sophisticated law enforcement tactics and investigative techniques not traditionally used in FCPA cases. In addition, Lanny A. Breuer, Assistant Attorney General of the DOJ's Criminal Division, has stated the DOJ's intent to focus on FCPA issues in the health care industry, with a specific focus on the pharmaceutical and medical device industries and the recent FCPA sting operation that netted 22 individuals should serve as a warning to these industries.
