Her clients come from all areas of the health care industry, including hospitals, physician group practices, laboratories, pharmacies, and distributors. She also works with clients in the financial sector, including the cryptocurrency and digital asset space. Elena conducts internal reviews and investigations and defends clients in white-collar criminal matters and civil litigation. She is skilled at counseling clients who are undergoing investigation by the U.S. Department of Justice (DOJ), the U.S. Department of Health and Human Services’ Office of Inspector General (OIG), the Securities and Exchange Commission (SEC), and other federal and state government authorities. She advises clients on responding to government-issued subpoenas and civil investigatory demands (CIDs) and in enforcement matters at both state and federal levels.

Elena also has experience advising clients on health care regulatory, transactional, and related matters, which contributes to her investigative toolbox as she is skilled in discerning potential risk areas and opportunities for improvement through her familiarity with these areas of practice. Additionally, Elena is adept at advising privately owned physician practices on their regulatory matters and focuses her counseling primarily on the plastic surgery, dermatology, and mental health areas of medical practice.

  • Defended an individual prosecuted by a U.S. Attorney’s Office (USAO) in a month-long criminal jury trial involving an alleged Ponzi scheme and the trading of cryptocurrency on foreign exchange markets where the client was charged with 10 counts related to wire fraud, securities fraud, and conspiracy to commit wire fraud and securities fraud. Elena secured the dismissal of one count pre-trial. After seven days of jury deliberation, the jury returned a verdict of five convictions and four acquittals. Elena successfully advocated for a 78-month sentence when the USAO requested 25 years and the Department of Probation recommended 85 years.
  • Represented an individual charged with 21 counts related to tax preparation fraud in a criminal tax prosecution investigated by the IRS’s Criminal Investigation Division, a USAO, and DOJ’s Tax Division. Elena successfully negotiated a rare and favorable plea agreement for this client pursuant to Federal Rule of Criminal Procedure 11(c)(1)(C), where the government stipulated to a below-Guidelines sentence range of six to 13 months. Through zealous and impassioned advocacy, Elena secured for the client the lowest possible sentence under the plea agreement—a six-month sentence.
  • Defended a highly regulated financial industry client in responding to multiple government-issued criminal and civil subpoenas from various enforcement agencies, and conducted an internal investigation into the highest level of employees and board members relating to fraud against the client. An internal investigation and cooperation with government prosecution led to multiple former employees and affiliates of the client being sentenced to time in prison and owing substantial sums (over $10 million) of restitution to the client.
  • Represented current and former high-level executives of health care and non-health care-related entities in their capacity as current and former employees of companies undergoing civil and criminal investigation by government authorities. Elena has represented such clients on appeals of conviction and in responding to inquiries from DOJ, the SEC, and OIG.
  • Defended a major hospital client in its response to a government subpoena issued by the Antitrust Division of the DOJ. In defending this client, Elena assisted in conducting an internal investigation involving multiple hospital campuses, technology vendors, and their executives, and assisted in overseeing a compliance review of the existing compliance program at the institution.
  • Served as defense counsel as part of a litigation team in connection with a False Claims Act qui tam litigation in which the government decided not to intervene.
  • Represented a specialty laboratory in responding to a CID issued by the DOJ involving numerous federal and state fraud and abuse investigations and hundreds of millions of dollars in Medicare and Medicare payments. Elena strategized CID responses and assisted this client in developing and implementing a comprehensive corporate compliance and training program, which contributed to a favorable settlement agreement for the client.
  • Completed a several-month part-time secondment in the General Counsel’s office of a large, not-for-profit hospital and medical center in the greater New York City area. Elena worked on various contractual, regulatory, and other diverse areas of health care practice, and advised hospital executives and administrators accordingly.
