When complicated regulatory compliance issues arise in Health Care real estate transactions, our attorneys work with attorneys in EBG's Health Care and Life Sciences Practice Group to make sure unique regulatory issues are appropriately addressed.

While the current economic downturn has had a significant affect on the real estate industry, health care real estate transactions have continued to proceed. Our attorneys recently worked on, among other transactions: (i) the preparation of condominium documents and a reciprocal easement agreement for a medical office condominium/ambulatory surgical center complex; (ii) the negotiation of a long-term ground lease on top of leased property, together with an easement and parking declaration for the development of a long-term acute care hospital; and (iii) the preparation of a long-term ground lease, parking easement agreement, and development agreement for a cancer center facility. In addition, we use our knowledge of the needs of health care facilities when navigating through land use and zoning matters for our clients. Many medical zonings matters call for the creation of medical mixed use zoning districts or other special use provisions to enable, for example, 24-hour use of certain facilities. Our experience enables EBG to provide effective health care real estate counsel while also providing healthcare regulatory guidance in furtherance of the development of medical facilities.
