Immigration Update: I-9 Audits, ICE Enforcement, and Managing Risk in an Economic Downturn

Event Information

10/7/2009 8:30 a.m. - 10:30
The Magnolia Hotel
1100 Texas Avenue
Houston, Texas 77002

Event Description

In light of the recent presidential election and the appointment of Janet Napolitano as Secretary of the Department of Homeland Security, the immigration spotlight is now on employer enforcement. This new administration has declared war on Texas employers. As immigration continues to move up on the government's agenda, workplace raids and employer fines are expected to increase exponentially. Some employers in Houston have already started to feel the impact of the government's enforcement strategies, with recent headlines including substantial criminal and civil penalties on Shipley's Donuts, and hundreds of employers being subjected to I-9 audits. This seminar will review the current legislative and enforcement landscape and provide practical guidance for employers on how to avoid being the next target.

EpsteinBeckerGreen attorneys Hector A. Chichoni, Nelsy C. Gómez, and Robert S. Groban, Jr. will cover the following topics:

  • What has ICE been doing to enforce employer compliance and what can employers expect from future immigration compliance efforts?
  • Form I-9 Compliance
  • Government Enforcement in the areas of H-1Bs and PERMs
  • Immigration Risk Management in a Poor Economy: What immigration policies and procedures do you need in place to safeguard your company during these tough economic times?
  • Participating in E-Verify and the Recent Mandate for Federal Contractors to join by September 8, 2009
  • What every employer needs to know about immigration reform efforts
  • Strategies for limiting liability risks from a multinational workforce, including topics ranging from information you can legally obtain in evaluating candidates for employment to recent cases where foreign nationals have successfully sued employers who failed to sponsor them for green cards
