Special Immigration Alert: USCIS Delays Implementation of E-Verify for Federal Contractors Until February 20, 2009

On June 6, 2008, President Bush amended Executive Order 12989 and directed federal agencies, starting January 12, 2009, to require federal contractors and subcontractors to use the E-Verify system to verify the employment eligibility of employees. On January 12, 2009, the U.S. Citizenship and Immigration Services extended the deadline for mandatory use of E-Verify by federal contractors and subcontractors to February 20, 2009. In acknowledgement of this extension, the Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council amended the Federal Acquisition Regulation (FAR). The FAR governs most federal contracts and solicitations. As a result, these agencies will not include a clause requiring the use of E-Verify in any contract solicitations or awards issued before February 20, 2009. The extension will become official once published in the Federal Register.
