Special Alert: USCIS Updates H-1B Count for FY 2010April 9, 2009
The U.S. Citizenship and Immigration Services ("USCIS") issued a press release today announcing that it had received approximately 42,000 H-1B petitions that count toward the Congressionally-mandated cap of 65,000, and that it continues to accept petitions subject to this cap.
At the same time, the USCIS announced that it had received approximately 20,000 petitions for foreign nationals with advanced degrees from U.S. universities. Although the cap exemption for this group of applicants is 20,000, the USCIS announced that it would continue to accept applications in this category because "experience has shown that not all petitions received are approvable."
