On Friday, June 26, 2009, the U.S. Citizenship and Immigration Services (USCIS) announced that it had extended the validity date past June 30, 2009, of the Form I-9, Employment Eligibility Verification (Rev. 02/02/09) currently on the USCIS web site. The USCIS has asked the Office of Management and Budget (OMB) to approve continued use of the current Form I-9 and has indicated that the current Form I-9 will remain valid while this request remains pending.
The USCIS will update the revision date on the Form I-9, once OMB approves the extension. Until OMB acts, the USCIS has indicated that employers will be able to continue using the Form I-9 (Rev. 02/02/09). Once the OMB approves the Form I-9 with the new revision date, the USCIS has indicated that employers will have the option of using either the Form I-9 on the USCIS website or the Form I-9 (Rev. 02/02/09) until further notice. This is because the form will not vary regardless of which of these Form I-9s is used by the employer.
