Special Alert: USCIS Continues to Accept H-1B Petitions for FY 2010April 8, 2009
The U.S. Citizenship and Immigration Services ("USCIS") issued a press release today announcing that it continues to accept new H-1B petitions subject to the 2010 quota. This may indicate that the 2010 quota was not reached through the initial filings. The USCIS says that it will continue to monitor closely the number of new H-1B petitions that are filed and issue another public announcement when it confirms that it has received sufficient filings to reach the quota. At that time, it will issue a "final receipt date" reflecting the last day that new H-1B petitions will be counted towards the 2010 quota. This "final receipt date" may be prior to the actual USCIS announcement and could be as early as April 7, 2009 if the USCIS discovers that it actually had received sufficient H-1B filings during the first week in April.
