But the DOJ disagreed, telling the Fourth Circuit that “the invoices Triple Canopy submitted to the [U.S.] Army make specific representations about the guard services provided.”

George B. Breen, a member at Epstein Becker Green, said that disagreements of that nature will hinge on fact-intensive analyses.

“It does raise the question as to … how much does the party have to say in order for it to arise to a specific representation,” Breen said. “And I think it’s really fact and circumstance dependent.”
