Retaliation risk is on the rise. For the past three years, retaliation claims have constituted the majority of claims filed with the EEOC, surpassing claims for age, disability, race, gender, and religious discrimination combined. Congress and the General Assembly have recently enacted sweeping anti-retaliation protections, including authorizing employees to recover treble damages under the Rhode Island Whistleblower’s Protection Act. And in late 2021, the EEOC, DOL, and NLRB announced a joint initiative to raise awareness about anti-retaliation protections in the workplace and enforce those protections aggressively.
