Employers and employees are facing unprecedented pressures in today's challenging economic environment. Employment lawyers need to consider offering their clients less expensive alternatives to litigating disputes, whether in union, private, or public sector employment settings, which may include negotiated settlements or mediation. When settlement is an option, counsel need to be thoughtful and strategic in planning for settlement discussions to resolve a case before litigation takes its toll on budgets, time, and patience.
