Wage and hour lawsuits and enforcement efforts have skyrocketed over the past few years, and health care companies are one of the primary targets. This alarming trend has been continuing in 2012. In recent weeks, the U.S. Department of Labor has initiated a number of surprise on-site audits. Likewise, class action lawsuits have increased exponentially, often resulting in settlements or judgments of millions of dollars. The issues generating the most litigation involve calculation of overtime, misclassification of employees as exempt or as independent contractors, automatic deductions for meal breaks, and working off the clock. In this presentation, we will cover best practices on the following topics:

  • The classification of employees as exempt or non-exempt
  • The calculation of an employee's regular rate of pay for determining overtime, especially when employees work in multiple classifications and receive non-discretionary pay
  • Off-the-clock work and how it may arise in the health care industry
  • Final payment of wages and the payout of accrued benefits
  • How to determine if your independent contractors are correctly classified
