Epstein Becker Green Webinar: HIPAA/HITECH Enforcement Is Here – Are You Ready?

After years of little or no enforcement, the Health Insurance Portability Accountability Act of 1995 ("HIPAA") has been supercharged by the Health Information Technology for Economic and Clinical Health Act ("HITECH"). With its increased enforcement and penalty provisions, HITECH has changed the enforcement landscape. Litigation under the HITECH provisions has already been initiated by at least one State Attorney General who is seeking substantial penalties for HIPAA violations.

Epstein Becker Green's Healthcare and Life Sciences Litigation and Government Investigations Practice presents a 90 minute webinar that examines the changes made to HIPAA through HITECH and the resulting increases in enforcement capabilities at both State and Federal levels. These Epstein Becker Green attorneys have significant experience in privacy and security issues, with specific expertise in presenting and responding to data breaches, in addition to wide experience in defending health care entities in government investigations and litigation.

Key points to be addressed:

  • HITECH's new breach notification rules.
  • HITECH's increased enforcement provisions, including exposure to actions by State Attorneys General.
  • How penalties could be tallied.
  • How to reduce reportable incidents.
  • Managing the government investigation and risk assessment and litigation defense strategies.
  • Business Associate Agreement impact.

Speakers: George B. Breen, Jesse M. Caplan, Robert J. Hudock, Mark E. Lutes, Carrie Valiant, Patricia M. Wagner
