The Equal Employment Opportunity Commission (EEOC) has “wellness plans” on its 2015 “to-do list.” The Chicago branch of the EEOC recently filed its third lawsuit alleging that an employer-sponsored wellness program violates the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA). In filing these lawsuits, the EEOC has challenged the Affordable Care Act’s (ACA) express approval of wellness programs. In addition, employers are preparing for the upcoming Cadillac tax and wellness programs may be the best chance to implement a long term strategy to avoid the tax. In this session, attendees learn about the rules currently governing wellness programs and how future legislation and regulations may impact their programs.
