Valerie Butera, Member of the Firm, will join the panel discussion, "2015-2016 Significant Decisions," at the 2016 Midwinter Meeting of the American Bar Association Occupational Safety and Health Law Committee, which runs from March 8 to 11, 2016.
The Occupational Safety and Health Administration primarily focused on enforcement activity in 2015 and provided relatively little decision-making in cases nationwide; however, there were notable court decisions made last year that continue to have impact on the OSHA landscape. This session will discuss six of the most significant cases of 2015, including two cases regarding the standard for willfulness in the Seventh Circuit, three decisions considering the standard for an employer's constructive knowledge of a hazard, and one decision related to the current rules on coal dust in mines.
